Hanamark Auto Transport Inc.

1. Definitions
“Company” refers to Hanamark Auto Transport Inc.
“Customer” refers to the person or business booking transportation services.
“Vehicle” refers to any automobile, truck, or equipment transported under this agreement.
2. Service Description
Hanamark Auto Transport Inc. provides automotive transport services within Canada, including but not limited to dealer trades, auction pickups, private shipments, and commercial fleet transport.
Transport dates provided are estimates only and may vary due to weather, traffic, mechanical issues, or carrier availability.
3. Booking, Pricing & Payment
All bookings must be confirmed in writing (email, text, or website form).
Prices are based on the information provided by the Customer.
If the vehicle is oversized, inoperable, loaded with personal items, or misrepresented, the Company may adjust pricing or refuse service.Payment is due in full before delivery, unless you agree in writing.
Storage or redelivery fees may apply if the Customer is unavailable at delivery.
4. Cancellations
Cancellations made before dispatch will be refunded minus a 100$ processing fee.
If the vehicle has already been dispatched, loaded, or en-route, the full transport fee is owed.
5. Vehicle Condition Requirements
Customer must ensure the vehicle is in safe, operable condition, unless the shipment is booked as “non-running.”
The vehicle must have:
keys
parking brake functioning
no major fluid leaks
steering operational
Personal items are not permitted unless pre-approved. The Company is not responsible for lost or damaged personal belongings.
6. Inspection & Bill of Lading
A driver inspection will be completed at pickup and delivery.
The Bill of Lading (BOL) is the official record of the vehicle’s condition.
Customer must review and sign the BOL at both pickup and delivery.
Failure to note damage at delivery may release the Company from liability.
7. Delays
Hanamark Auto Transport Inc. is not liable for any delays caused by:
mechanical breakdown
weather
border delays
road closures
auction release issues
unforeseen carrier scheduling changes
Customer acknowledges that delivery times are estimates, not guarantees.
8. Insurance & Liability
The Company provides cargo insurance during transport, subject to policy limits and exclusions.
Insurance covers vehicle damage caused by the carrier, not:
pre-existing damage
fluid leaks
undercarriage or suspension wear
personal items inside the vehicle
chips or scratches caused by road debris
acts of nature (hail, storms, flying debris)
Maximum liability is limited to the amount paid for transportation.
9. Customer Responsibilities
The Customer must:
Provide accurate pickup and delivery addresses
Ensure someone is available for release and delivery
Remove all personal items
Disable toll tags
Provide correct vehicle information (VIN, model, operability)
10. Missed Delivery / Redelivery
If the Customer or delivery contact is unavailable:
The vehicle may be placed in paid storage
Redelivery fees may apply
The Company is not responsible for delays caused by missed appointments
11. Fuel, Battery, and Mechanical Issues
The Company is not responsible for:
Dead batteries
Low fuel
Check-engine lights
Mechanical breakdowns before or after transport
Transporting a vehicle does not guarantee mechanical condition.
12. Personal Belongings
No personal items are covered under carrier insurance.
Any items inside the vehicle are transported at the Customer’s own risk.
13. Disputes
Any claims for damage must be submitted in writing within 24 hours of delivery, with photos and a copy of the BOL.
Disputes shall be governed by the laws of the Province of Saskatchewan, Canada, unless otherwise stated.
14. Acceptance of Terms
By booking transport with Hanamark Auto Transport Inc., the Customer acknowledges and agrees to these Terms & Conditions.
